WWE cleared:
WWE have won the first battles in the wave of concussion lawsuits vs former talents. A judge today threw out two cases, that of Big Vito and former PC student Evan Singleton. Vito's case was thrown out because he was flaky on details over the matches he claimed he was hurt in, did not provide medical reports to back his claims up and was poor under questioning, at one point admitting he had not re-watched any of the matches he cited as the ones he was hurt in to freshen his memory, or point out the moments he was injured. Singleton's claim was dropped after he admitted he did not attend a class on concussion awareness and that his injury was his own mistake (He landed badly after botching taking a chokeslam). The judge said he can't find against WWE for withholding information when they had offered a class on the subject that he had chosen not to go to.
The judge also cited reasons for dismissal which will please the promotion, but worry others that have filed. He said he found no evidence that WWE could possibly know in advance that wrestling could cause long term neurological issues. He said he could not find proof in the allegations against the WWE doctor, because he was not assosciated with the company during Vito's tenure, never mind as far back as 1980. He rejected the work of Chris Nowinski, because there was no proof WWE were aware of his work at the time of the alleged injuries, or that WWE covered up the damage to Chris Benoit's brain to avoid criticism in the press, although did concede that WWE did try to discredit the findings regarding Benoit.
